NAFTA tribunal orders Ottawa to Compensate Ontario Feed-In Tariff Investor

With thanks to colleagues at the International Institute for Sustainable Development’s Investment Treaty Newsmy summary of a North American Free Trade Agreement (NAFTA) Chapter 11 arbitration award against the Government of Canada is now published online. The NAFTA tribunal ordered Canada to pay an American wind power developer more than CAD28 million. It did so on the basis that Ontario’s Feed-In Tariff (FIT) for green energy had been administered in a manner that was neither fair nor equitable.
